Terms and conditions of service for business customers

AGREEMENT BETWEEN CUSTOMER AND FINANCIAL SCHEDULING SERVICES INC.

Services offered

Financial Scheduling Services Inc. online scheduling software(referred hereinafter as “Financial Scheduling Services”, “our”, “we” and or “us”) offers business customers(also referred hereinafter as “customers”, “customer”, “subscriber”, “you” and or “your”) who agree to the following terms and conditions of service ( hereinafter the “Terms and Conditions”) the ability(the “service”) to schedule appointments and enable wholesalers to schedule appointments via the internet on a customized web site( the “site”) hosted and maintained by Financial Scheduling Services. To use the services, the customer must obtain access to the internet, either directly or through devices that access web-based content, and pay any services fees associated with such access. In addition, the customer must provide all equipment necessary to make such connection to the internet, including a computer and modem or other access device.

Catering Services

All catering services will have a 15% gratuity added to all orders. Financial Scheduling Services Inc. will do it's best to accommodate all catering orders, but not all catering services are available in all areas. Should the services you requested not be available in that area. We will contact the person who placed the order and inform them of their options. Should we not be able to reach that person no services will be scheduled. All catering orders must be canceled at least 48 hours prior to the event to not be responsible for the order. Should you want to cancel inside the 48 hours window, we will do are best to stop the order. Should you need a special request please call (847) 704-0357 and we will do are best to accommodate you. All order receipts are sent to you via e-mail.

Your registration obligation

In consideration of use of the service, you agree to:

  • Provide true, accurate, current and complete information about your business as prompted in enrollment, and
  • Maintain and promptly update your business account, schedule, personnel records to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, Financial Scheduling Services has the right to suspend or terminate your account and refuse any and all current or future use of the service (or any portion thereof).
  • Keep all of your published data on the site compliant with our acceptance of use policy.

Financial Scheduling Services Privacy Policy

Pursuant to Financial Scheduling Services privacy policy, we may disclose to third parties certain aggregate information contained in your business account data or related data, provided that, such information will not include personally identifying information, except as specifically authorized by you or in the good faith belief that such action is reasonably necessary to comply with the law, legal process, or to enforce the terms and conditions.

Member account, password, and security

You will receive a password and account designation upon completing our enrollment process. You are responsible for maintaining the confidentiality of the password and account desigination, and are fully responsible for all activities that occur under your password or account. You agree to:

  • Immediately notify Financial Scheduling Services of any unauthorized use of your password or account or any other breach of securities, and
  • Ensure that you exit from your account at the end of each session.
  • Financial Scheduling Services cannot and will not be liable for any loss or damage arising from your failure to comply with this section or from any loss or damage arising from the actions of any third party.

Restrictions on use of service

Except as expressly permitted, you may not reproduce, disclose, redistribute, retransmit, publish, assign, transfer or commercially exploit any of the services or any other content that you receive, directly or indirectly, through the services to anyone without notice and prior written approval from Financial Scheduling Services. You may not use or permit anyone to use the information provided through the services for any unlawful or unauthorized purpose.

Modifications to service

Financial Scheduling Services reserves the right at any time, and from time to time, to modify, suspend or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. You agree that Financial Scheduling Services shall not be liable to you or to any third party for any modification, suspension or discontinuance of the service.

Termination

You agree that Financial Scheduling Services, at its sole discretion, may terminate your password, account (or any part thereof) or use of the services, and remove and discard any content within the service, for any reason, including, but without limitation, lack of use. If Financial Scheduling Services believes that you have violated or acted inconsistently with the letter or spirit of the terms and conditions, your account may be effected without prior notice, and you acknowledge and agree that Financial Scheduling Services may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the service.

Dealing with customers

Your correspondence or business dealings with customers found on or through the service, are solely between you and such customers. You agree that Financial Scheduling Services shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the results of the presence of such customers on the service.

Abuse

Any use of Financial Scheduling Services application, systems and system resources that disrupts the normal use of the system for other Financial Scheduling Services customers and users is considered to be abuse of system resources, and is grounds for administrative intervention.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

"YOU ARE USING THE SERVICES AT YOUR OWN RISK. THE SERVICES ARE DISTRIBUTED ON AN “AS IS” BASIS AND “AS AVAILABLE” BASIS AND THERE MAY BE DELAYS, OMISSIONS, ERRORS OR INACCURACIES IN SUCH INFORMATION AND DATA. THE SERVICES ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OF FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION, OR MODIFICATION UNDER THE LAWS APPLICABLE TO THE TERMS AND CONDITIONS. YOU WILL BEAR ANY AND ALL LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICES OR INABILITY TO USE THE SERVICES OR OUT OF ANY BREACH OF ANY WARRANTY.

Protection of terms and services

The provisions of the terms and conditions are for the benefit of each providing party. Each providing party shall have the right to assert and enforce the provision of the terms and conditions directly on their own behalf.

Conflicts

Neither the course of conduct between Financial Scheduling Services and you nor trade practices shall act to modify the provisions of the terms and conditions.

Intellectual property

You acknowledge that Financial Scheduling Services has exclusive proprietary rights of the information received by you through the services. The Services are protected by copyrights, trademarks, service marks, and patent right laws of the United States.
